President-elect Donald Trump intends to fire special counsel Jack Smith and his team of prosecutors and initiate a Justice Department investigation into alleged fraud in the 2020 election, according to a Washington Post report. The move is part of Trump’s broader plan to restructure the department and “clear out the bad guys,” a source familiar with his agenda told the publication.

The dismissal of Smith and his prosecutors would target career attorneys who pursued two federal indictments against Trump. These individuals, often shielded from political reprisal, would face termination under Trump’s renewed “Schedule F” executive order. Initially enacted in 2021, the order aimed to reclassify federal employees, streamlining the firing process, but it was reversed by President Joe Biden.
In a statement, Trump’s press secretary, Karoline Leavitt, asserted, “President Trump won the election in a landslide because Americans are sick of their tax dollars being wasted targeting political opponents while violent criminals roam free.” Leavitt’s remarks underscore Trump’s commitment to reshaping the Justice Department and targeting perceived partisanship.
While addressing the Justice Department’s internal reforms is reportedly Trump’s primary focus, the president-elect also plans to assemble investigative teams to review evidence of fraud in battleground states from the 2020 election. Despite the lower prioritization of election investigations, Trump has repeatedly insisted the election was “stolen” and vowed accountability for those involved in alleged misconduct.
“Those involved in unscrupulous behavior will be sought out, caught, and prosecuted at levels, unfortunately, never seen before in our Country,” Trump wrote on Truth Social in September.
As part of his restructuring, Trump plans to appoint loyalists to key roles within the Justice Department. This includes installing Pam Bondi, former Florida attorney general and a previous member of Trump’s administration, to replace outgoing appointee Matt Gaetz. Additionally, three attorneys who represented Trump in legal cases since 2020 are expected to assume senior positions.
