Texas Attorney General Ken Paxton announced that his office is suing Pfizer, alleging the pharmaceutical giant defrauded the Texas Medicaid program by providing sub-quality drugs to Texas children. According to the lawsuit Pfizer and Tris Pharma continually manipulated the pediatric attention-deficit/hyperactivity disorder medication Quillivant XR during the period of 2012 to 2018, resulting in patients receiving drugs well below the quality alleged by the pharmaceutical companies.
“I am horrified by the dishonesty we uncovered in this investigation,” Attorney General Ken Paxton said in a statement. “Pfizer and Tris intentionally concealed and failed to disclose the issues with Quillivant to receive taxpayer funded benefits through Texas Medicaid, defrauding the state and endangering children. Our Civil Medicaid Fraud Division has done an outstanding job holding these pharmaceutical companies accountable.”

According to the Attonrey General, Pfizer misrepresented data to officials with the Texas Medicaid program, making it appear Quillivant was in compliance with federal and state law. In reality Pfizer concealed the fact Quillivant was an adulterated drug, its quality far lower than what had been attested to.
“At no point did Defendants warn Texas Medicaid providers or decision-makers that Quillivant had known manufacturing issues affecting its efficacy, thereby depriving the Medicaid program of the crucial information it relies on,” read the allegations in the lawsuit against Pfizer and Tris Pharma. “As a result, thousands of Texas children received an adulterated Schedule II Controlled Dangerous Substance.”
After emerging victorious against a politically–motivated impeachment and removal attempt by a coalition of Democrats and moderate Texas Republicans, Attorney General Paxton promised he’d double down on his legal pursuit of the Biden White House and their political allies.
